Privacy and Personal Data Protection Statement

1. Who we are

This statement explains how Ascend Packaging Services LLC ("Foldems," “Pinch Pac” "we," "us" or "our") collects, uses, shares and protects personal information through www.foldems.net (the "Site") and in connection with our single-portion packaging products and services. We are based in Cypress, Texas, USA. You can reach us at sales@foldems.net. By using the Site, you agree to the practices described here. If you do not agree, please do not use the Site.

2. Information we collect

We collect only what we need to respond to you, quote and fulfill orders, and run the Site.

  • Contact details. Your name, company, job title, email address and phone number, which you give us through our contact and quote forms, by email or by phone.

  • Business and project details. Information such as product type, fill volume, quantities, timelines and artwork, which you share in quote requests and project communications.

  • Order and billing details. Your shipping and billing addresses and order history, collected at checkout and when we invoice you.

  • Payment details. Card or account details, which are processed directly by our payment provider. We do not store full card numbers.

  • Technical and usage data. Your IP address, browser, device, the pages you view and the site that referred you, collected through cookies and similar technologies.

  • Marketing preferences. Your newsletter sign-ups and opt-outs, collected through our forms and email links.

We do not knowingly collect sensitive personal data, such as health, financial account, biometric or government ID information. Please do not send it to us.

3. How we use information

We use personal information to:

  • Respond to inquiries and prepare custom quotes

  • Process, package, ship and invoice orders

  • Manage client projects, including artwork and product specifications

  • Send service messages, such as order updates and changes to our terms

  • Send marketing emails, only where you have opted in or where the law allows; you can unsubscribe anytime

  • Improve the Site, our products and our customer service

  • Protect against fraud, misuse and security threats

  • Comply with legal, tax, accounting and regulatory obligations

We do not sell your personal information, and we do not use it for targeted advertising profiles.

4. Cookies and analytics

The Site and its hosting platform use cookies and similar technologies to keep the Site working, remember your cart and preferences, and measure traffic.

  • Essential cookies run core features such as security, the shopping cart and checkout.

  • Analytics cookies show us, in aggregate, how visitors find and use the Site.

You can block or delete cookies in your browser settings. Some features, such as checkout, may not work without essential cookies. Where required, we ask for your consent before setting non-essential cookies.

5. Sharing and disclosure

We share personal information only as described below.

  • Service providers who help us run the business, such as website hosting, payment processing, email, shipping carriers and accounting. They may use the information only to provide services to us.

  • Legal and safety reasons, when required by law, subpoena or court order, or to protect our rights, customers or others.

  • Business transfers, if Foldems or its assets are sold, merged or transferred. The buyer would be bound to handle the information consistently with this statement.

  • With your consent, for any other purpose you approve.

Client formulas, artwork and project details are treated as confidential business information. We use them only to deliver your order.

6. Text messaging (SMS)

We use applications to send and receive text messages. If you opt in, for example by checking the SMS consent box on a form, texting us first or agreeing verbally, we collect your mobile number, name and message content. We use them to send order updates, quote follow-ups, customer service replies and, where you have agreed, occasional promotional messages.

  • Consent. We send texts only to people who have opted in. Consent to receive texts is not a condition of any purchase.

  • Frequency and cost. Message frequency varies. Message and data rates may apply.

  • Opt out. Reply STOP at any time to stop receiving texts. Reply HELP for help, or contact us at [phone number] or [privacy@foldems.net].

  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We share mobile numbers and opt-in status only with providers that deliver our messages, such as RingCentral or other applications and phone carriers, and only for that purpose.

7. Data security and retention

We use reasonable administrative, technical and physical safeguards to protect personal information. These include encrypted (HTTPS) connections, access limited to staff who need it, and trusted service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

We keep personal information only as long as needed for the purposes in this statement. That includes completing orders, keeping business and tax records, and resolving disputes. After that, we delete or anonymize it.

If a data breach affects your personal information, we will notify you and the authorities as required by law.

8. Your rights and choices

Depending on where you live, including Texas, California and other U.S. states with privacy laws, you may have the right to:

  • Know and access the personal information we hold about you

  • Correct inaccurate information

  • Delete your information, subject to legal exceptions

  • Get a portable copy of your information

  • Opt out of the sale of personal information, targeted advertising and profiling (we do none of these)

  • Not be discriminated against for using these rights

To make a request, email sales@foldems.net. We may need to verify your identity first, and we will respond within 45 days. If we deny your request, you may appeal by replying to our decision. If you are still unsatisfied, you may contact your state attorney general.

You can opt out of marketing emails anytime by clicking "unsubscribe" in any email or by contacting us.

9. Children, international visitors and other websites

Children. The Site is intended for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.

International visitors. We operate in the United States, and your information is processed and stored there. U.S. data protection laws may differ from those in your country. By using the Site, you understand that your information will be transferred to the U.S.

Other websites. The Site may link to third-party websites or services, such as payment providers or social media. Their own privacy policies apply, and we are not responsible for their practices.

10. Changes and contact

We may update this statement from time to time. When we do, we will post the new version on this page and change the effective date at the top. If the changes are significant, we will give more prominent notice.
